Terms of Use

These Terms of Use ("Terms") are an agreement between you and 60Clicks Media, LLC, an Arizona limited liability company ("WatchPatrol", "we", "us"). They govern your use of the WatchPatrol website (www.watchpatrol.net), the WatchPatrol apps for iOS and Android, and the WatchPatrol MCP server and API (together, the "Service"). By using the Service or creating an account, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we collect and use personal information, and is part of these Terms.

1. What WatchPatrol is

WatchPatrol is a search engine and index for pre-owned watches. We collect listings that sellers have published on third-party forums and marketplaces, organize them by brand and model, and provide search, alerts, price history, and related tools. Registered users can also post their own listings and message other users.

WatchPatrol is not a party to any sale. We do not own, inspect, or sell the watches listed, we do not handle payments or shipping, and we do not verify sellers, buyers, or listings. Any transaction is solely between the buyer and the seller. You are responsible for your own due diligence, including confirming a seller's identity, a watch's authenticity and condition, and safe payment methods.

2. Eligibility and accounts

You must be at least 13 years old to use the Service (16 in the European Economic Area and United Kingdom). You must be at least 18, or the age of majority where you live, to post a listing or to contact a seller about a purchase.

You are responsible for the information you give us, for keeping your sign-in credentials secure, and for all activity under your account. Do not share your account or create accounts to get around a suspension, a block, or a usage limit. Tell us promptly at [email protected] if you think your account has been compromised.

3. Listings we index

Listings in WatchPatrol's search results, or linked from those results, are created by people over whom WatchPatrol has no control. They are collected automatically and are not screened before they appear. WatchPatrol cannot confirm that sellers are who they claim to be, and assumes no responsibility for the content, accuracy, completeness, legality, reliability, or availability of any listing, item, or website included in or linked from the Service.

Information we add, such as brand and model matches, price estimates, valuations, price history, seller history and risk signals, and watch identification results, is generated automatically and may be wrong. It is provided for general information only and is not an appraisal, an authentication, or a recommendation to buy or sell.

4. Your content

"Your content" means anything you submit to the Service, including listings, photos, messages, reports, feedback about sellers, alerts, and Collection entries. You keep ownership of your content. You give WatchPatrol a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt (for example, resizing photos or translating text), and distribute your content as needed to operate, promote, and improve the Service. For content you make public, such as listings and seller feedback, this license includes showing it to other users and through our apps, MCP server, and API. The license ends when your content is deleted from the Service, except for copies kept as described in our Privacy Policy, and except for content others have already shared.

You confirm that you have the rights needed to submit your content, that it is accurate, and that it does not violate these Terms or anyone else's rights.

If you post a listing, you must own the watch or be authorized to sell it, describe it honestly (including its condition and any non-original parts), and keep the listing up to date. We may limit the number of active listings, photos, and messages per account.

5. Acceptable use

You agree not to:

  • post fraudulent, misleading, or inaccurate listings, or list counterfeit, replica, or stolen goods;
  • use the Service to scam, harass, threaten, or impersonate anyone;
  • post hate speech, sexually explicit material, or any content that is unlawful or infringes the rights of others;
  • send spam or unsolicited commercial messages, or use contact details obtained through the Service for anything other than a genuine inquiry about a listing;
  • interfere with the Service, probe or bypass its security, rate limits, or access controls, or introduce malware;
  • access the Service in ways that violate section 6.

WatchPatrol has no tolerance for objectionable content or abusive users. Users may report any listing or seller from within the WatchPatrol website and apps, and may block any seller so that the seller's listings no longer appear in that user's results. WatchPatrol reviews every report and will remove offending content and terminate the accounts or listings of abusive users at its sole discretion. You may also report content directly to [email protected].

Although we have no obligation to do so, we may monitor, edit, hide, or remove any listing or other content that we determine, in our sole discretion, is illegal, fraudulent, inaccurate, no longer available, or otherwise violates these Terms or is inappropriate. We do not promise to remove any particular content.

6. Use of WatchPatrol data, the MCP server, and the API

WatchPatrol makes listing, pricing, and catalog data available through the website, the apps, the WatchPatrol MCP server, and the WatchPatrol REST API. Your use of that data through any of these channels is subject to these Terms. You may not use robots, spiders, scrapers, or other automated means to access, crawl, or copy the website or apps.

The MCP server is provided for interactive use: asking questions about WatchPatrol data through an AI assistant or chat session. You may connect it from any compatible client, including developer tools. You may not use the MCP server for scheduled or automated data collection, bulk download or export, building or maintaining datasets, or supplying data to any product or service, whether or not you charge for it.

Automated, bulk, or commercial use of WatchPatrol data requires access to the REST API under a separate agreement with 60Clicks Media, LLC. To request access, contact [email protected].

Keep your API keys and access tokens confidential. You are responsible for all use made with them. We may apply rate limits and usage caps to any account, and may change them at any time.

7. Plans

Some features and usage limits depend on your account's plan. Paid plans and commercial API access, where offered, are subject to the pricing and any additional terms presented when you sign up for them. If those terms conflict with these Terms, those terms apply to the paid service.

8. Our intellectual property

The Service, including its software, design, catalog, text, and the WatchPatrol name and logo, is owned by 60Clicks Media, LLC and protected by copyright, trademark, and other laws. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in line with these Terms. We reserve all rights not expressly granted.

Watch brand names, model names, and logos shown on the Service belong to their respective owners. WatchPatrol is not affiliated with, sponsored by, or endorsed by any watch brand, and their use is only to identify the watches listed.

If you send us suggestions or feedback about the Service, we may use them without any obligation to you.

9. Copyright and listing complaints

If you believe content on the Service infringes your copyright, or you are a seller who wants a listing removed or corrected, email [email protected]. For copyright complaints, include the work you believe is infringed, the URL of the content, your contact details, a statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. We may terminate the accounts of repeat infringers.

10. Third-party sites and services

The Service links to forums, marketplaces, and other websites that we do not own or control ("External Sites"). We are not responsible for External Sites, their content, or their availability, and your use of them is subject to their own terms and policies. Some links, including links to eBay, are affiliate links: we may earn a commission if you make a purchase after following them. This does not change the price you pay.

11. Communications

By creating an account, you agree that we may send you emails and, if you allow them, push notifications about your account and the features you use, such as alert matches, messages, and changes to listings you starred. We may also send personalized recommendations and announcements about WatchPatrol. You can turn off optional emails and notifications at any time in your settings or with the unsubscribe link in each email.

12. Suspension and termination

You can stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access to the website, the apps, the MCP server, the API, or your account, with or without notice, if we determine in our sole discretion that you have violated these Terms, that your use creates risk or legal exposure for us or others, or that we are required to do so by law. We may also change or discontinue any part of the Service. Sections 3, 4 (for content already shared), 8, and 13 through 16 continue after your account ends.

13. Disclaimers

THE SERVICE AND ALL CONTENT AND DATA ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT LISTINGS, PRICES, VALUATIONS, OR IDENTIFICATIONS ARE ACCURATE, COMPLETE, OR CURRENT, OR THAT ANY SELLER, BUYER, OR ITEM IS GENUINE OR TRUSTWORTHY.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, 60CLICKS MEDIA, LLC AND ITS MEMBERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, ANY LISTING, OR ANY TRANSACTION OR DISPUTE BETWEEN USERS OR WITH SELLERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND US $100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits rights you have under laws that cannot be waived by contract.

15. Indemnity

You agree to defend, indemnify, and hold harmless 60Clicks Media, LLC and its members, employees, and suppliers from any claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your transactions with other users or sellers, or your violation of these Terms or of anyone else's rights.

16. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Arizona for any dispute arising from these Terms or the Service, except where the law of your country of residence gives you the right to bring proceedings elsewhere.

17. Apple app users

If you use the WatchPatrol app on an Apple device, these Terms are between you and 60Clicks Media, LLC, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims. To the extent permitted by law, Apple has no warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the Apple Media Services Terms and Conditions.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the date at the top of this page. If we make significant changes, we will also let you know by email or with a notice on the Service before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms.

19. General

These Terms, together with the Privacy Policy and any additional terms for paid services, are the entire agreement between you and WatchPatrol about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a merger, acquisition, or sale of assets.
